Violations or the perceived violations of Business Ethics and/or contractor labor laws can have a significant, often negative, impact on a contractor if not appropriately handled. As a contractor with employees, you are subject to audits and investigations by multiple labor oversight agencies, including DOL, OFCCP, and OIG. If an audit or even the probability of an audit is looming, you need outside help. Led by our in-house Employment Law Attorney, our HR consulting team is uniquely qualified to perform investigations and support you in an investigation of any employment related issue such as complaints of discrimination, harassment or retaliation, ethics and business conduct concerns and whistleblower complaints. We are also available to assist you in responding to an EEOC Charge of Discrimination.

Services

  • Internal Investigations – It can be uncomfortable, but there are instances when companies must perform internal investigations of potential or perceived ethics or labor law violations. Bringing in a neutral third party to perform this type of investigation can be best for everyone involved. Our experts will conduct sensitive investigations of potential wrongdoing and complaints of hostile work environment, discrimination, and harassment.
  • Department of Labor (DOL) Investigations – Your employees are encouraged by DOL to pick up the phone and report any violation of applicable labor laws, including SCA non-compliance. Our experts are available to be your liaison and manage the process if subjected to an investigation by the Wage & Hour or OFCCP divisions.
  • Equal Employment Opportunity Commission (EEOC) Support – If an Equal Employment Opportunity (EEO) complaint is brought against you or your company, we can assist throughout the process. Our experts will work with you to understand the situation, review applicable documentation, interview relevant witnesses and prepare a response to the EEOC that positions you for a favorable determination.
  • Whistleblower/Ethics Related Investigations – Internal allegations of company misconduct by a whistleblower are not highly common, but they do happen. Allegations of this nature must be reported to the Office of Inspector General (OIG) and must also be investigated internally. Our team is highly experienced in assisting with investigations of whistleblower complaints, potential improper business practices, or concerns related to alleged violations of ethics laws.
  • Office of Inspector General (OIG) Investigations – Investigations by the OIG of a contractor are time-consuming, intimidating, costly, and can be devastating to your company. Our experts are available to be your liaison and manage the production of documents, prepare witnesses, and help mitigate a detrimental outcome.
  • Coordination of Outside Counsel – In the event of litigation, or government investigations that outside counsel manages, our experts are available to help you and your team through the process. We can coordinate background information, assist with document production, and communicate and collaborate with outside counsel, as needed, so that you are free to run your business rather than becoming consumed with legal matters.
  • Compliance/Corrective Action Plans – DoL and OIG Investigations often result in agreed-upon or even mandated Compliance Action Plans. Our team is available to assist you in completing all steps required to demonstrate compliance, including serving as an independent “compliance monitor,” performing as your liaison with the government agency, assisting with any required training, and helping you through any necessary corrective action.
